1.1 These General Terms and Conditions ("GTC") apply to all mediation and booking services provided by FinTours (hereinafter "FinTours", "we", or "us") via the website www.fintours.org, our AI assistant (Mira), or via phone/email communication.
1.2 FinTours operates exclusively as a Travel Intermediary (Vermittler). We mediate travel services (e.g., individual flights, hotel accommodations, private transfers) provided by third-party suppliers (e.g., airlines, hotels, tour operators).
1.3 In the case of brokered individual services, the travel contract is concluded exclusively and directly between you (the customer) and the respective third-party travel provider. FinTours is not a contracting party to the travel service itself and is not liable for the provision of the travel service.
1.4 Exception for Package Travel: If FinTours explicitly curates and invoices a combined "Holiday Package" under its own name as defined by the EU Package Travel Directive (Directive (EU) 2015/2302), FinTours acts as the Tour Operator. This will be explicitly stated on your booking confirmation.
2.1 Booking Request: Filling out the booking form or using our AI assistant (Mira) on our website constitutes a non-binding inquiry.
2.2 Final Quotation: Due to the dynamic nature of luxury travel and airline pricing, we will review your inquiry and provide a final, binding quotation detailing availability, final prices, baggage rules, and supplier terms.
2.3 Binding Booking: By accepting our final quotation (via email confirmation, portal acceptance, or payment), you instruct FinTours to conclude the contract with the third-party provider on your behalf.
2.4 Rejection: FinTours and the respective providers reserve the right to reject booking requests without stating reasons, particularly in cases of suspected fraud or credit card discrepancies.
3.1 Fares: Mediated travel services are subject to the prices set by the third-party providers. All final prices include applicable taxes and standard fees.
3.2 FinTours Service Fee: For our concierge and mediation services, FinTours may charge a service/booking fee. This fee is always transparently displayed in your final quotation before you confirm the booking. The service fee is non-refundable, even in the event of a cancellation by the airline or the customer.
3.3 Payment Collection: FinTours may collect the total travel price on behalf of the provider (Inkasso). Payments must be made using the methods provided (Credit Card, Bank Transfer). If a payment is charged back or fails, you are liable for all resulting banking and administrative fees.
4.1 Delivery: Tickets, vouchers, and itineraries are delivered electronically via email and accessible in the FinTours Customer Portal.
4.2 Duty to Inspect: You are obligated to check all booking confirmations and travel documents (especially names, dates, and routing) immediately upon receipt. Names must exactly match the machine-readable zone of the passport/ID. Errors must be reported to FinTours instantly. FinTours assumes no liability for costs arising from incorrect details provided by the customer.
5.1 Provider Rules: Cancellations and rebookings are governed entirely by the General Terms and Conditions and fare rules of the respective travel provider (e.g., the airline's conditions of carriage). Many discounted or promotional fares are non-refundable and cannot be changed.
5.2 Processing: All requests for cancellations or changes must be submitted through the FinTours customer portal or support email.
5.3 Processing Fees: FinTours charges an administrative fee (as outlined in our current fee schedule at the time of booking) for processing cancellations, rebookings, or refund requests on your behalf, independent of the fees charged by the airline or hotel.
6.1 Customer Liability: You are exclusively responsible for complying with all domestic and international travel regulations. This includes possessing a valid passport (often required to be valid for 6 months beyond the return date), necessary visas, transit visas, and mandatory vaccinations.
6.2 Information: Any information provided by FinTours regarding entry requirements is non-binding and subject to change by government authorities at any time. We strongly advise checking with the respective embassy/consulate of your destination and transit countries.
7.1 Mediation Liability: FinTours is liable for the careful selection of providers, proper processing of the booking, and the forwarding of documents. We are liable for intent and gross negligence.
7.2 No Liability for Travel Services: FinTours is not liable for the actual performance of the booked services. We accept no liability for flight delays, cancellations, overbookings, lost luggage, or the insolvency of a travel provider.
7.3 Force Majeure: FinTours is not liable for failures or delays caused by circumstances beyond our reasonable control, including natural disasters, pandemics, acts of war, or technical failures of Global Distribution Systems (GDS).
8.1 Jurisdiction: This agreement is governed by the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).
8.2 Consumers: For consumers, the mandatory consumer protection laws of their country of residence remain unaffected.
8.3 Online Dispute Resolution: The European Commission provides a platform for online dispute resolution (ODR): http://ec.europa.eu/consumers/odr. FinTours is neither willing nor obligated to participate in dispute resolution proceedings before a consumer arbitration board.
